    ORDER
    Islamabad, the February 21st, 2024 

    S.R.O. No. 232 (I)/2024 dated 21st February 2024 - WHEREAS the United Nations Security Council vide its resolutions nos. 1493 (2003), 1533 (2004), 1552 (2004), 1596 (2005), 1616 (2005), 1649 (2005), 1654 (2006), 1698 (2006), 1768 (2007), 1771 (2007), 1799 (2008), 1804 (2008), 1807 (2008), 1857 (2008), 1896 (2009), 1952 (2010), 2021 (2011), 2078 (2012), 2136 (2014), 2198 (2015), 2293 (2016), 2360 (2017), 2528 (2021), 2582 (2021), 2641 (2022), 2667 (2022), and 2688 (2023) and all relevant previous resolutions concerning the Democratic Republic of Congo (DRC) have imposed an arms embargo against all non-governmental entities and individuals operating in the territory of the DRC and have directed to apply travel restrictions and to freeze the funds and other financial resources of certain individuals and entities under Chapter VII of the United Nations Charter;

    2. AND WHEREAS the United Nations (Security Council) Act, 1948 (XIV of 1948) enjoins upon the Federal Government to apply certain measures for giving effect to the decisions of the United Nations Security Council;

    3. NOW, THEREFORE, in exercise of the powers conferred by section 2 of the United Nations (Security Council) Act, 1948 (XIV of 1948), the Federal Government is pleased to order that the following measures be imposed against all non-governmental entities and individuals operating in the territory of the DRC and the individuals and entities, listed in the Annex to this order reflecting the updates/changes made by the 1533 (2004) the Democratic Republic of Congo Sanctions Committee of the United Nations Security Council;  

    (a) Arms Embargo AND WHEREAS through paragraph 1 of the United Nations Security Council resolution 2688 (2023) and paragraph 1 of the United Nations Security Council resolution 1807 (2008) adopted under Chapter VII of the United Nations Charter, the United Nations Security Council has decided that until 1 July 2024, all Member States shall take the necessary measures to prevent the direct or indirect supply, sale or transfer, from their territories or by their nationals, or using their flag vessels or aircraft, of arms and any related materiel, and the provision of any assistance, advice or training related to military activities, including financing and financial assistance, to all nongovernmental entities and individuals operating in the territory of the Democratic Republic of the Congo;

    (b)Travel Ban AND WHEREAS through paragraph 1 of the United Nations Security Council resolution 2688 (2023) and paragraph 9 of the United Nations Security Council resolution 1807 (2008) adopted under Chapter VII of the United Nations Charter, the United Nations Security Council has decided that until 1 July 2024, all Member States shall take the necessary measures to prevent the entry into or transit through their territories of all persons designated by the Committee, provided that nothing in this paragraph shall obligate a State to refuse entry into its territory to its own nationals;

    (c)Assets Freeze AND WHEREAS through paragraph 1 of the United Nations Security Council resolution 2688 (2023) and paragraph 11 of the United Nations Security Council resolution 1807 (2008) adopted under Chapter VII of the United Nations Charter, the United Nations Security Council has decided that until 1 July 2024, all Member States shall immediately freeze the funds, other financial assets and economic resources which are on their territories, which are owned or controlled, directly or indirectly, by persons or entities designated by the Committee, or that are held by entities owned or controlled, directly or indirectly, by them or by any persons or entities acting on their behalf or at their direction, as designated by the Committee, and has decided further that all Member States shall ensure that no funds, financial assets or economic resources are made available by their nationals or by any persons within their territories, to or for the benefit of such persons or entities;

    AND WHEREAS through paragraph 3 of the United Nations Security Council resolution 2688 (2023) adopted under Chapter VII of the United Nations Charter, the United Nations Security Council has reaffirmed that financial and travel measures imposed by paragraphs 9 and 11 of resolution 1807 (2008) shall apply to individuals and entities as designated by the Committee for engaging in or providing support for acts that undermine the peace, stability or security of the DRC, as set forth in paragraph 7 of resolution 2293 (2016) and has further decided that such acts include planning, directing, sponsoring or participating in attacks against MONUSCO peacekeepers or United Nations personnel, including members of the Group of Experts; 

    On 20 February 2024, the Security Council Committee established pursuant to resolution 1533 (2004) concerning the Democratic Republic of the Congo approved the addition of the entries specified below to its Sanctions List of individuals and entities subject to the measures imposed by the Security Council and adopted under Chapter VII of the Charter of the United Nations.

He has effective command and control over the militia’s combatants.
