ORDER
Islamabad, the March 6th,
2024
S.R.O.
No. 347 dated 6th March 2024 -
WHEREAS the United Nations Security Council vide its resolutions nos. 2653
(2022), and 2700 (2023) concerning Haiti have directed to impose travel ban,
asset freeze and targeted arms embargo against designated individuals and
entities under Chapter VII of the United Nations Charter;
2. AND WHEREAS the United Nations
(Security Council) Act, 1948 (XIV of 1948) enjoins upon the Federal Government
to apply certain measures for giving effect to the decisions of the United
Nations Security Council;
3. NOW, THEREFORE, in exercise of the powers
conferred by section 2 of the United Nations (Security Council) Act, 1948 (XIV
of 1948), the Federal Government is pleased to order that the
following measures be imposed against all designated individuals and entities,
listed in the Annex to this order reflecting the updates/changes made by the 2653
(2022) the Sanctions Committee of the United Nations Security Council
concerning Haiti;
(a) Travel Ban
AND WHEREAS
through paragraph 3 of the United Nations Security Council resolution 2653 (2022)
and paragraph 3 of United Nations
Security Council resolution 2700 (2023) adopted under Chapter VII of the United
Nations Charter, the United Nations Security Council has decided that until 19th
October 2024, all Member States shall take the necessary measures to prevent
the entry into or transit through their territories of all persons designated
by the Committee, provided that
nothing in this paragraph shall obligate a State to refuse entry into its
territory to its own nationals;
(b)Assets Freeze
AND WHEREAS
through paragraph 6 of the United Nations Security Council resolution 2653 (2022)
and paragraph 3 of the United Nations Security Council resolution 2700 (2023)
adopted under Chapter VII of the United Nations Charter, the United Nations
Security Council has decided that until 19th October 2024, all
Member States shall immediately freeze the funds, other financial assets and
economic resources which are on their territories, which are owned or
controlled, directly or indirectly, by persons or entities designated by the
Committee, or that are held by entities owned or controlled, directly or
indirectly, by them or by any persons or entities acting on their behalf or at
their direction, as designated by the Committee, and has decided further that all
Member States shall ensure that no funds, financial assets or economic
resources are made available by their nationals or by any persons within their
territories, to or for the benefit of such persons or entities;
(c) Arms Embargo
AND WHEREAS
through paragraph 11 of the United Nations Security Council resolution 2653
(2022) and paragraph 6 of the United Nations Security Council resolution 2700
(2023) adopted under Chapter VII of the United Nations Charter, the United
Nations Security Council has decided that until 19th October 2024,
all Member States shall take the necessary measures to prevent the direct or
indirect supply, sale or transfer, from their territories or by their
nationals, or using their flag vessels or aircraft, of arms and any related
materiel of all types including weapons and ammunition, military vehicles and
equipment, paramilitary equipment and spare parts for the aforementioned, and
technical assistance, training, financial or other assistance, related to
military activities or provision, maintenance or use of any arms and related
material, including the provision of armed mercenary personnel whether or not
originating in their territories, to all designated individuals and entities by
the Sanctions Committee of the
United Nations Security Council concerning Haiti;
